This Digital Image License applies to photographs, digital image files, video recordings, audio recordings, video stills, extracted frames, previews, screenshots, and related media created, captured, delivered, or made available by Godfrey Photography LLC (“Media”).

By accessing, downloading, sharing, printing, or using any Media, the Client acknowledges and agrees to be bound by this Digital Image License and any signed photography agreement between the Client and Godfrey Photography LLC.

1. Copyright Ownership

All Media created by Godfrey Photography LLC remains the sole and exclusive property of Godfrey Photography LLC and is protected under United States copyright law.

No copyright ownership or intellectual property ownership is transferred to the Client.

This license grants limited personal usage rights only.

2. Personal Use License

Upon full payment of all amounts due, Godfrey Photography LLC grants the Client a limited, non-exclusive, non-transferable, perpetual license to use delivered Media for personal, non-commercial purposes, subject to the terms of this Digital Image License and the Client’s signed photography agreement.

Permitted personal uses include:

Downloading and storing delivered Media for personal use

Printing delivered Media for personal display

Unlimited personal printing through any printing provider of the Client’s choosing

Sharing delivered Media with family and friends for personal, non-commercial use

Posting delivered Media on personal social media accounts

Using delivered Media for personal announcements, holiday cards, wedding announcements, graduation announcements, or similar personal uses

Cropping or resizing delivered Media for personal display, printing, or social media formatting

This license does not transfer copyright ownership. All rights not expressly granted remain reserved by Godfrey Photography LLC.

3. Prohibited Uses

Without prior written permission from Godfrey Photography LLC, the Client may not:

Sell, license, sublicense, or redistribute the Media

Transfer usage rights to any other person, business, vendor, venue, publication, organization, or third party

Use the Media for commercial, promotional, advertising, editorial, or business purposes

Provide the Media to businesses, vendors, venues, publications, organizations, or other third parties for promotional or commercial use

Submit the Media to stock photography, media licensing, or content platforms

Enter the Media into contests as the creator, author, or photographer

Remove copyright notices, metadata, watermarks, or attribution information, if present

Claim authorship or ownership of the Media

Use the Media in a misleading, unlawful, defamatory, obscene, or harmful manner

4. Editing and Image Integrity

To preserve artistic integrity and brand consistency, the Client may crop or resize delivered Media for personal use.

The Client may not, without prior written permission from Godfrey Photography LLC:

Apply filters, presets, overlays, or color changes

Re-edit or substantially alter the Media

Apply artificial intelligence modifications

Use AI tools to alter, enhance, generate, replace, expand, or modify the Media

Use the Media for AI training, datasets, machine learning, or similar technologies

Create derivative works from the Media

Manipulate the appearance of the Media in a way that changes the original artistic intent

If the Client alters delivered Media in any way, the Client may not represent the altered version as Godfrey Photography LLC’s original work or tag, credit, or identify Godfrey Photography LLC in connection with the altered version without prior written permission.

5. Wedding and Event-Specific Terms

For weddings, events, and similar sessions, this license is granted only to the Client unless otherwise stated in writing.

Vendors, venues, planners, florists, DJs, makeup artists, hair stylists, publications, businesses, and other third parties are not granted usage rights under this license.

Any vendor, venue, publication, business, or third party wishing to use Media for commercial, promotional, advertising, editorial, portfolio, website, social media, or business purposes must obtain written permission and licensing directly from Godfrey Photography LLC.

Personal social media sharing by the Client, family, and friends is permitted, provided the use remains personal and non-commercial.

6. Photographer Usage and Portfolio Rights

Unless otherwise agreed in writing, Godfrey Photography LLC retains the right to use Media created during a session for legitimate business purposes, including but not limited to:

Portfolio display

Website content

Social media content

Blog posts

Advertising

Marketing materials

Printed promotional materials

Studio samples

Educational purposes

Google Business Profile content

Business listings and directories

No additional compensation shall be provided for such use.

7. Privacy Option

Clients may request the Privacy Option no later than twenty-four (24) hours before the scheduled session.

Upon approval by Godfrey Photography LLC and full payment of the applicable Privacy Option fee in effect at the time of booking, Godfrey Photography LLC agrees not to use delivered Media for:

Portfolio display

Website content

Social media content

Advertising

Marketing materials

Promotional materials

The Privacy Option becomes effective only after approval by Godfrey Photography LLC and full payment of the applicable Privacy Option fee.

Privacy Option requests submitted less than twenty-four (24) hours before the session may be denied at Godfrey Photography LLC’s discretion.

The Privacy Option does not apply to:

Media published before approval of the Privacy Option

Non-identifying imagery

Venue or location photographs

Behind-the-scenes content

Internal business records

Archival storage

Insurance documentation

Legal proceedings

Business bookkeeping records

The Privacy Option fee is non-refundable after session completion.

8. Print Services and Quality Notice

Clients are encouraged to order prints and products directly through Godfrey Photography LLC to help ensure professional color accuracy and print quality.

Clients may print delivered images independently at their discretion; however, Godfrey Photography LLC is not responsible for print quality, color accuracy, cropping, paper choice, lab errors, or other issues resulting from third-party labs or outside printing providers.

9. Third-Party and Commercial Licensing

This license does not permit use by third parties.

Any commercial, promotional, advertising, editorial, business-related, vendor, venue, publication, or third-party use requires a separate written license issued by Godfrey Photography LLC.

Permission must be granted in writing before any such use.

10. Revocation of License

Godfrey Photography LLC may revoke this license if the Client violates any of its terms.

Unauthorized use may result in legal action, licensing fees, removal requests, damages, and/or other remedies available under applicable law.

11. Signed Agreement Controls

If there is any conflict between this Digital Image License and the Client’s signed photography agreement, the signed photography agreement shall control.

12. Changes to This License

Godfrey Photography LLC reserves the right to update or modify this Digital Image License from time to time.

Any changes will apply to future sessions and future media deliveries only and will not retroactively affect licenses granted prior to the effective date of such changes.

13. Governing Law

This license shall be governed by and interpreted in accordance with the laws of the State of Ohio, United States.
