These Terms of Service (“Terms”) govern your use of the website and services provided by Godfrey Photography LLC (“we,” “us,” or “our”). By accessing this website, booking photography services, or purchasing any products or services, you agree to these Terms.


If you do not agree, please do not use our website or services.



1. Services

Godfrey Photography LLC provides professional photography and related services, including but not limited to portrait sessions, family sessions, couples sessions, events, weddings, and digital image delivery. Services, pricing, and availability may change at any time.



2. Website Use Disclaimer

Information provided on this website is for general informational purposes only and does not constitute legal, financial, or professional advice. Use of this website does not create a client relationship unless services are formally booked and confirmed.



3. Booking, Payments & Contracts

  • Booking requests may be submitted through our website or booking platform.
  • Sessions are not considered confirmed until any required retainer or payment is received.
  • Certain services, including weddings and events, may require a separate written contract. In the event of a conflict, the written contract will take precedence over these Terms.



4. Authority to Enter Agreement

You represent that you are at least 18 years of age and have the legal authority to enter into agreements on behalf of yourself and any other participants included in the session or event.



5. Cancellations, Rescheduling & Refunds

Cancellation and rescheduling policies vary by service type and will be communicated at booking or outlined in a written agreement. Retainers are used to reserve time and may be non-refundable unless otherwise stated in writing.



6. Delivery Timelines

Delivery timelines are estimates and not guaranteed. Delays may occur due to workload, editing requirements, illness, equipment issues, or other unforeseen circumstances.



7. Artistic Style & Creative Control

Clients acknowledge familiarity with Godfrey Photography LLC’s portfolio and artistic style. Editing, composition, and creative decisions are made at the photographer’s discretion. Requests for additional edits may be accommodated at our discretion and may incur additional fees.



8. Digital Image Delivery

Digital images are currently included with session fees unless otherwise stated. Godfrey Photography LLC reserves the right to modify delivery methods, image quantities, or pricing structures in the future. Any changes apply only to bookings confirmed after such changes are published.



9. Digital Images & Licensing

  • All images remain the copyrighted property of Godfrey Photography LLC.
  • Clients receive a personal, non-commercial license for personal use.
  • Images may not be sold, altered, or used for commercial purposes without written permission.
  • A separate Digital Image License may apply and is incorporated by reference.



10. Image Use & Alteration

Clients may share delivered images for personal use. Credit to Godfrey Photography LLC is appreciated but not required. Clients may not apply heavy filters, distortions, or edits that materially alter the appearance or artistic integrity of the images.



11. Portfolio & Promotional Use

Unless otherwise requested in writing prior to the session, Godfrey Photography LLC may use images for portfolio, website, social media, and marketing purposes. Clients may request exclusion from promotional use by notifying us in writing before image delivery.



12. Location Permissions

Clients are responsible for obtaining permission to photograph at private residences, venues, or public locations where permits or approvals may be required. Godfrey Photography LLC is not responsible for denied access, restrictions, or interruptions due to lack of permission.



13. Audio & Video Recording

Some services may include video and audio recording. By participating in a session or event, clients grant consent for audio and video capture of themselves and attendees for the purpose of delivering contracted services.



14. Minors & Group Photography

The client represents that they have the authority to consent on behalf of any minors photographed. For group or event photography, the client is responsible for informing participants that photography and/or videography is taking place.



15. Delays & Interference

Godfrey Photography LLC is not responsible for reduced coverage due to late arrivals, weather, traffic, venue delays, guest interference, schedule changes, or circumstances beyond our control. Session time is not extended for delays caused by the client or third parties.



16. No Guarantee of Attendance or Cooperation

Godfrey Photography LLC is not responsible for lack of cooperation, availability, or participation of subjects, guests, or event attendees. The quality and completeness of coverage may be affected by factors beyond our control, including behavior, timing, and compliance of individuals present.



17. Image Loss, Data Failure & Force Majeure

While reasonable precautions are taken to protect images and data, no system is infallible. Godfrey Photography LLC is not responsible for loss of images or data due to circumstances beyond our control, including but not limited to equipment malfunction, memory card failure, data corruption, theft, fire, accident, acts of nature, or government restrictions.



18. Service Issues & Remedies

In the event that Godfrey Photography LLC fails to perform the agreed-upon services due to circumstances solely within our control, liability is limited to a full refund of all amounts paid, including any retainer.


If issues arise due to factors outside our control — including weather, illness, equipment failure, venue restrictions, guest behavior, schedule changes, or lack of cooperation — no refund is guaranteed, and liability remains limited as outlined in these Terms.



19. Limitation of Liability

To the fullest extent permitted by law:

  • Godfrey Photography LLC makes no guarantees regarding specific images, moments, or outcomes.
  • Under no circumstances shall Godfrey Photography LLC be liable for indirect, incidental, or consequential damages, including emotional distress or loss of enjoyment.
  • Liability is strictly limited to the amounts paid for services.



20. Third-Party Services

We use third-party platforms for booking, payment processing, gallery delivery, and website hosting. Godfrey Photography LLC is not responsible for outages, failures, or policy changes of third-party providers.



21. Dispute Resolution

In the event of a dispute, the parties agree to attempt to resolve the matter informally and in good faith before pursuing formal legal action.



22. Governing Law

These Terms are governed by the laws of the State of Ohio and the United States, without regard to conflict of law principles.



23. Changes to These Terms

We may update these Terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
